A. Construction and demolition activity, excluding emergency work, shall be performed between the hours of 7:00 a.m. and 6:00 p.m. on weekdays, and between the hours of 9:00 a.m. and 5:00 p.m. on Saturdays and federal holidays. No commercial work is allowed on Sundays. All motorized equipment used in construction and demolition activity shall be operated with a muffler. No earthwork associated with commercial or industrial construction will be permitted on weekends.
B.The Uniform Construction Code Official of the Borough of Madison has the authority to extend the aforementioned hours after a determination that the public health, safety and welfare will not be impaired by construction activity and that there is sufficient justification for a waiver.
Article III. Hours of Construction, Power Equipment Use
§ 208-11. Hours restricted activities permitted.
The activities restricted by this chapter shall be permitted only during the following hours:
A. Weekdays: 8:00 a.m. to 7:00 p.m.
B. Saturdays: 9:00 a.m. to 6:00 p.m.
C. Sundays or federal holidays: 9:00 a.m. to 6:00 p.m. by occupants of the premises only.
§ 208-12. Exceptions.
The restrictions of this chapter shall not apply to the following:
A. Activities confined within a wholly enclosed building or structure.
B. Activities conducted pursuant to and within the terms of a permit issued by the Borough Administrator where he finds the public welfare will be enhanced by the work or will be harmed by the failure to perform the work at the times indicated therein.
C .Activities necessary to prevent injury to persons or property, including snow removal.
D. Activities conducted by or for any government unit or agency.
§ 208-13. Enforcement.
The Construction Code Official or his authorized representative and the Chatham Borough Police Department are hereby authorized to enforce the provisions of this Article III.
