ORDINANCE 10-2001

ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 134, SECTION 10 OF THE BOROUGH CODE ENTITLED "PARKING PERMITS"

WHEREAS, the Police Chief of the Madison Borough Police Department has recommended that the Borough Code be amended to eliminate non-resident parking permits and to set new fees for all parking permits; and

WHEREAS, the Police Chief has recommended that parking permit fees for 2001 be as follows: Tenant Residing In Madison’s Historic District or in a dwelling on the South side of Kings Road from 124 East to Green Avenue - $200.00; Resident Commuter - $250.00; Merchant - $200.00; Daily commuter parking - $5.00.

NOW, THEREFORE, BE IT ORDAINED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey as follows:

SECTION 1: Section 134-10 of the Borough Code entitled "Parking Permits" is hereby amended to read as follows:

 

§ 134-10. Parking permits.

 

A. Applications for parking permits shall be made to the Chief of Police on forms supplied by the Police Department. Permits will be issued to permit holders, thereby enabling permit holders to transfer said permits from vehicle to vehicle.

 

B. Fees.

(1) When making application for a permit, the vehicle owner requesting the same shall pay to the borough the following fee for each permit:

 

(a) Tenant Residing In Madison’s Historic District or in a dwelling on the South side of Kings Road from 124 East to Green Avenue. A permit for a borough resident living in a dwelling in Madison’s Historic District or in a dwelling on the South side of Kings Road from 124 East to Green Avenue shall be $200.00 for the year 2001. This fee shall thereafter be set each year by resolution on January 1 by the Borough Council upon the recommendation of the Borough Chief of Police.

 

(b) Resident Commuter - Borough of Madison Resident. A permit for any borough resident: $250.00. This fee shall thereafter be set each year by resolution on January 1 by the Borough Council upon the recommendation of the Borough Chief of Police.

 

(c) Merchant. A permit for an owner or employee, certified to be an employee by the owner, of a commercial establishment located in the borough: $200.00 for permits in the Cook Avenue Lot, the Elmer Street Lot, the Green Avenue Lot and Kings Road Lot Nos. 1, 2 and 3. This fee shall thereafter be set each year by resolution on January 1 by the Borough Council upon the recommendation of the Borough Chief of Police.

 

(d) Resident Commuter. A permit for a borough resident's vehicle as defined § 134-6I(4) for Kings Road Lot Nos. 1, 2 & 3 shall be $250.00.

 

(e) Replacement fee for a lost or mutilated permit: 50% of permit fee.

 

(f) One-day permit. A temporary permit authorizing the parking of a vehicle in Kings Road Lot No. 3 (unnumbered spaces), where permit parking is permitted, limited to parking solely on the single day noted on the temporary permit: $5.00. This fee shall thereafter be set each year by resolution on January 1 by the Borough Council upon the recommendation of the Borough Chief of Police.

 

(2) All fees shall be paid to the Police Department of the borough.

 

(3) In the event that application shall be made after December 1 of any year, the above fee for said year shall be prorated 50%.

 

SECTION 2: This Ordinance shall take effect as provided by law.
