MADISON ZONING BOARD OF ADJUSTMENT NOTICE OF DECISION

   

TAKE NOTICE, that at the regular meeting of the Zoning Board of Adjustment of the Borough of Madison held on Thursday, January 11, 2007 at 7:30 pm, in the Board Room of the Hartley Dodge Memorial, Kings Road, Madison, NJ, the Board took the following action: 

 

MINUTES-Meeting Minutes of 12/14/06 were adopted as amended.

 

RESOLUTIONS

CASE NO. Z-05-68-Resolution denying the adjournment request and dismissing without prejudice the

Variance and Site Plan Application of J & R Rentals, LLC for property known as Block 3001, Lot 22,

located at 25 Green Village Road, Madison was adopted.

 

CASE NO. Z-06-45- Resolution in the Matter of the Application of Chrison S. Kellogg, and Helen R. Kaar, Block 1001, Lot 27, 3 Walnut Street, Madison, requesting relief from the Zoning Board of

Adjustment pursuant to N.J.S.A. 40:55D-70b for an interpretation of the Zoning Ordinance as applied to the plans filed for the construction of a single-family dwelling was adopted.

 

CASE NO. Z-06-47- Resolution granting the Variance Application of Michael and Christine Driscoll,

Block 4312, Lot 10, 165 Green Village Road, Madison, to construct proposed 1 story addition, 2-story

addition and covered porch onto the existing single-family dwelling was adopted.           

 

CASE NO. Z-06-49- Resolution granting the Variance Application of Joseph Palawasta, Block 0913,

Lot 3, 59 Valley Road, Madison, for the removal and replacement of existing 2nd story, proposed front

porch, stoop and walkway, proposed detached garage, removal and expansion of existing driveway

on property was adopted.

 

CASE NO. Z-06-50 –Resolution granting the Variance Application of Neil and Sharon Hunt, Block

2203, Lot 8, 3 Toothe Place, Madison, to construct proposed second story addition above the existing

garage/den on property was adopted.

 

OLD BUSINESS

CASE NO. Z-06-32- Application of Omar and Sunita Jaffrey, Block 3404, Lot 1.01, 74 Glenwild Road, Madison, to construct (2) 2-story additions, exterior basement entrance to existing dwelling on property located in a R-1 (Single Family Residential) Zone District. The Board carried the continued public hearing on the application to the next regular meeting of February 8, 2007 for further proceedings per the request of the applicant. No further notice is required.  

 

CASE NO. Z-06-46- Application of Joseph Caruso, Block 0909, Lot 18, 54 Valley Road, Madison,

requesting permission to construct proposed expansion of existing first story and second story addition onto the existing single family dwelling, on property located in a R-3 (Single Family Residential) Zone District, requiring Variance relief from the minimum front yard setback, maximum principal building coverage and maximum impervious lot coverage requirements was approved subject to certain conditions.

Action to be memorialized at the February 8, 2007 meeting.

CASE NO. Z -06-48- Application of Grace Episcopal Church, Block 3001, Lots 5 & 6, 4 Madison

Avenue, Madison requesting Conditional Use (d) Variance Approval, Associated Variance Relief and

Site Plan Approval to construct an addition to the existing church for a new parish hall and Sunday school

classrooms, and additional parking on property located in a (P) Professional Office/Residential Zone

District. The Board continued the hearing on the application, which was carried to the February 8, 2007 meeting for further proceedings. No further notice is required.

 

CASE NO. Z-06-51- Application of Griffith and Aimee Fielding, Block 0911, Lot 7, 2 Sherwood

Avenue, Madison, requesting permission to construct proposed 1 story addition and 2nd story dormer

onto the existing dwelling on property located in a R-3 (Single Family Residential) Zone District, requiring Variance relief from the minimum rear yard setback and maximum principal building

coverage requirements. The application was approved subject to certain conditions. Action to be

memorialized at the February 8, 2007 meeting.

 

CASE NO. Z-06-52- Application of Lois and Sandeep Bhatt, Block 4203, Lot 11, 117 Green Avenue, Madison, requesting permission to construct the proposed front stoop and overhang onto the existing

dwelling on property located in a R-2 (Single Family Residential) Zone District, requiring Variance

relief from the minimum front yard setback and maximum impervious lot coverage requirements.

The application was approved subject to certain conditions. Action to be memorialized at the

February 8, 2007 meeting.

 

CASE NO. Z-06-41- Application of Commerce Bank/North (Applicant) for Use Variance and Associated

Variances on a bifurcated basis, with site plan to be filed after the use variance is secured on property

commonly known on the Madison Borough Tax Maps as Block 4501, Lots 7 & 8, Green Village Road & Shunpike Road, Madison, for the construction of a Drive-Thru Bank, which is not a permitted use in the

P (Professional Office/Residential) Zone District at the Intersection of Green Village Road and Shunpike Road. The Board continued the hearing on the Use Variance application. The applicant agreed to make Site Plan Application, which will be considered concurrent with the Use Variance Application in anticipation of the next hearing date scheduled as a special meeting for March 1, 2007 for further

proceedings.

 

NEW BUSINESS

CASE NO. Z-06-53- Application of Hi-Tech Builders/Ozzie Yaseen, Block 4305, Lot 22,

7 Roscoe Avenue, Madison, for the construction of a 2-story dwelling on property, requiring Variance relief from the minimum side yard setback requirements. The application was carried to the February 8, 2007 meeting for the initial hearing. No further notice is required.

 

CASE NO. Z-06-54- Application of Harvey Levine, Block 0506, Lot 18,  9 Myrtle Avenue, Madison,

to grant a use variance for a two-family structure on the subject property located in a R-3 (Single Family

Residential) Zone District, which does not permit Two Family Dwellings. The application was carried

to the February 8, 2007 meeting for the initial hearing. No further notice is required.

 

CASE NO. Z-06-55- Application of Rolanne Henry, Block 2303, Lot 24, 10 Pine Tree Terrace,

Madison, for the construction of a 2nd story addition onto the existing single-family dwelling on property,

requiring Variance relief from the minimum front yard setback requirements. The application was carried

to the February 8, 2007 meeting for the initial hearing. No further notice is required.

CASE NO. Z-06-56-Application of Arkadiusz & Justyna P. Maluszczak, Block 601, Lot 13,

150 Ridgedale Avenue, Madison, for the construction of a new single family dwelling with Variance relief for a right side yard setback of 6 feet where 12 feet is required on a pre-existing lot with reduced lot width. The property is located in a R-3 (Single Family Residential) Zone District. The application was carried to the February 8, 2007 meeting for the initial hearing. No further notice is required.   

 

CASE NO. Z-06-57-Application of Patrick and Kim Culligan, Block 4502, Lot 8, 61 Garfield Avenue, Madison, for the construction of a 1 story addition, porch & stoop, Hot Tub and Patio Modifications onto the existing single family dwelling on property, requiring Variance relief from the maximum impervious lot coverage requirements. The application was carried to the February 8, 2007 meeting for the initial hearing. No further notice is required.

 

CASE NO. Z-06-58- Application of Paul and Lisa Racicot, Block 4601, Lot 50, 100 Shunpike Road,

Madison, to grant a Variance of Section 195-25.5 of the Madison Land Development Code to maintain a

6 ft. wooden picket privacy fence along the eastern and western edges of  the property. The application was carried to the February 8, 2007 meeting for the initial hearing. No further notice is required.
