ZONING BOARD OF ADJUSTMENT

 

 

TAKE NOTICE, that at the regular meeting of the Zoning Board of Adjustment of the Borough of Madison held on Monday, November 20, 2006 at 7:30 pm, in the Board Room of the Hartley Dodge Memorial, Kings Road, Madison, NJ, the Board took the following action: 

 

MINUTES-Meeting Minutes of 10/12/06 were adopted as amended.

 

RESOLUTIONS

CASE NO. Z-06-38 – Resolution granting the Variance Application of Mark and Therese Tallmadge,

Block 3101, Lot 26, 8 Ross Court, Madison, to construct the proposed 1 story addition and Portico onto

the existing single-family dwelling was adopted.

 

CASE NO. Z-06-39 – Resolution granting the Variance Application of Michael and Danielle Miller,

Block 504, Lot 14, 30 Canterbury Road, Madison, to construct the proposed 2-story addition to the

existing single-family dwelling was adopted.

 

CASE NO. Z-06-40 – Resolution granting the Variance Application of Mark and Virginia McBride,

Block 4101, Lot 10, 50 Midwood Terrace, Madison, to construct the proposed 2-story addition onto

the existing dwelling was adopted.

 

RESOLUTION- Appointment of P. David Zimmerman, P.P., as Special Conflicts Planner and Hal

Simoff, P.E., as Special Conflicts Traffic Engineering Consultant was adopted.

 

RESOLUTION- Appointment of Thomas J. Germinario, Esq. as Substitute Counsel was adopted.

   

OLD BUSINESS

CASE NO. Z-05-68- Application of J & R Rentals, LLC Block 3001, Lot 22, 25 Green Village Road, Madison, for Preliminary and Final Site Plan Approval and Variance Relief, to enlarge the building and grant a height variance: 35 feet is allowed, 41 feet 7 inches is requested for the property located in a P (Residential/Office) Zone District, Block 3001, Lot 22, 25, Green Village Road. Applicant also is requesting a variance to allow the previously approved residential apartment to be moved from the second floor to the third floor. Mixed office and residential use is not allowed in the zone. The Board carried the continued public hearing on the application to December 14, 2006 meeting for further proceedings per the request of the applicant. No further notice is required. 

 

CASE NO. Z-06-28- Application of Peter and Gemma Iossa, Block 0801, Lot 6, 6 Seven Oaks Circle, Madison requesting permission to erect a 2 car garage, construct a 1 story addition, deck, removal of existing driveway and construction of a new driveway on property located in a R-3 Zone District, requiring Variance relief from the minimum front yard setback, minimum side yard setback, minimum rear yard setback and maximum building coverage requirements. The application was approved subject

to certain conditions. Action to be memorialized at the December 14, 2006 meeting.

 

CASE NO. Z-06-32- Application of Omar and Sunita Jaffrey, Block 3404, Lot 1.01, 74 Glenwild

Road, Madison, to construct (2) 2-story additions, exterior basement entrance to existing dwelling on property located in a R-1 (Single Family Residential) Zone District, requiring Variance relief from the minimum front yard setback, minimum rear yard setback, maximum principal building coverage and

maximum impervious lot coverage. The Board carried the continued public hearing on the application to December 14, 2006 meeting for further proceedings per the request of the applicant. No further notice is required.

NEW BUSINESS

CASE NO. Z-06-36 – Application of Larry and Jean Sher, Block 3301, Lot 4, 32 Kitchell Road,

Madison, to demolish the existing dwelling and erect the proposed 2-1/2-story dwelling and arbor on

existing flag lot was withdrawn by the applicant.

 

CASE NO. Z-06-37- Application of Ted and Ellen McLean, Block 4204, Lot 3, 10 Midwood Terrace,

Madison, requesting permission to construct proposed 2-story addition, 1 story addition, 2nd story

additions, In-ground pool and deck, requiring Variance relief from the minimum side yard setback requirements. The application was approved subject to certain conditions. Action to be memorialized at

the December 14, 2006 meeting.

 

CASE NO. Z-06-41- Application of Commerce Bank/North (Applicant) for Use Variance and Associated

Variances on a bifurcated basis, with site plan to be filed after the use variance is secured on property

commonly known on the Madison Borough Tax Maps as Block 4501, Lots 7 & 8, Green Village Road & Shunpike Road, Madison, for the construction of a Drive-Thru Bank, which is not a permitted use in the P (Professional Office/Residential) Zone District at the Intersection of Green Village Road and Shunpike Road. Additional variance relief is required for maximum impervious coverage, sign variances and any other additional variances that may be deemed necessary by the Zoning Board of Adjustment at the time of the public hearing. The application was partially heard and carried to the January 11, 2007 regular meeting for further proceedings. No further notice is required.

 

CASE NO. Z-06-43- Application of Richard and Gale Taylo, Block 0601, Lot 2, 9 Burnet Road, Madison, requesting permission to construct front porch and stairs, on property located in a R-3

(Single Family Residential) Zone District, requiring Variance relief from the minimum front yard

setback requirements. The application was approved subject to certain conditions. Action to be memorialized at the December 14, 2006 meeting.

 

CASE NO. Z-06-44- Application of Martin and Leslie Barry, Block 4802, Lot 3, 37 Barnsdale Road, Madison, requesting permission to construct proposed 1 story addition to the existing kitchen, on

property located in a R-2 (Single Family Residential) Zone District, requiring Variance relief from the

maximum principal building requirements. The application was approved subject to certain conditions. Action to be memorialized at the December 14, 2006 meeting.

 

CASE NO. Z-06-45- Application of Chrison S. Kellogg, AIA and Helen R. Kaar, Block 1001, Lot 27,

3 Walnut Street, Madison, on property located in a R-3 (Single Family Residential) Zone District,

requesting relief from the Zoning Board of Adjustment pursuant to N.J.S.A. 40:55D-70b for an

interpretation of the Zoning Ordinance as applied to the plans filed for the construction of a single family

dwelling. As to whether or not a permit may be issued based upon the prevailing setback as described in the plans filed with the application. Alternatively, applicant requests a variance from the 35-foot minimum front yard setback requirement (25’ Prevailing), Section 195-29.3 of the Madison Land Use Regulations. The Board carried the initial hearing on the application to the December 14, 2006 meeting per the request of the applicant. No further notice is required.

 

CASE NO. Z-06-46- Application of Joseph Caruso, Block 0909, Lot 18, 54 Valley Road, Madison,

requesting permission to construct proposed expansion of existing first story and second story addition onto the existing single family dwelling, on property located in a R-3 (Single Family Residential) Zone District, requiring Variance relief from the minimum front yard setback, maximum principal building coverage and maximum impervious lot coverage requirements. The application was partially heard and

carried to the December 14, 2006 meeting for submission of more detailed plans. No further notice is required.

Z-06-47- Application of Michael and Christine Driscoll, Block 4312, Lot 10, 165 Green Village Road, Madison, requesting permission to construct proposed 1 story addition, 2-story addition and covered porch onto the existing single family dwelling, on property located in a R-3 (Single Family Residential) Zone District, requiring Variance relief from the minimum front yard setback (Green Village Road and Strickland Place) requirements. The Board carried the initial hearing on the application to the December 14, 2006 meeting. No further notice is required.
