MADISON ZONING BOARD OF ADJUSTMENT NOTICE OF DECISION

PLEASE TAKE NOTICE, that at a regular meeting of the Zoning Board of Adjustment of the Borough of Madison held on Monday, September 19, 2005 at 7:30 PM, in the Board Room of the Hartley Dodge Memorial, Kings Road, Madison, the following action was taken:

 

Approval of Minutes- Regular Meeting Minutes of 8/10/2005 was adopted as corrected.

 

      RESOLUTIONS

            CASE NO. Z-05-25- Resolution granting the Variance Application of William D. Vaughan,

             Block 910, Lot 6, 6 Hamilton Street, Madison, requiring Variance relief from the minimum rear

             yard setback and maximum impervious lot coverage was adopted.

 

            CASE NO. Z-05-29- Resolution granting the Variance Application of Patrick & Heather Shields,

            Block 209, Lot 5.08, 11 Wisteria Court, Madison, requiring Variance relief from minimum front

            yard setback, minimum rear yard setback and maximum impervious coverage was adopted.

           

           CASE NO. Z-05-32 –Resolution granting the Variance Application of James and Rose Mikula,

           Block 101, Lot 22, 41 Shadylawn Drive, Madison, requiring Variance relief from minimum front

           yard setback was adopted.

 

          OLD BUSINESS

          CASE NO. Z-05-34 Variance Application of Larry and Linda O’Gorman, Block 3805, Lot 10,

          18 Albright Circle, Madison requesting permission to construct proposed 2nd story addition on

          the existing structure on property located in a R-2 Zone District, requiring Variance relief from

          the minimum front yard setback was approved subject to certain conditions. Action to be

          memorialized at a later date.

 

          CASE NO. Z-05-27- Application of Louis and Patricia DeBiasse, Block 2101, Lot 18, 34 Lewis

          Drive, Madison, filed as Zoning Appeal and Variance Application and request for Waiver of

          Parking Site Plan Details or other relief so as to Appeal the Decision of the Zoning Officer and

          obtain relief from the accessory use and conditional use requirements to relocate the applicant’s

          existing professional dental practice from Hamilton Street to 34 Lewis Drive, which generates

          medical waste; and to obtain relief to exceed the maximum impervious coverage limitation of the

          zoning regulations in the R-2, Single Family Residential Zone District was denied.  Action to be

          memorialized at the October 17, 2005 meeting.

      

          CASE NO. Z-05-30 Variance Application of Richard DeSalvo, 9 Baumgartner Drive, Madison,

          Lot 5.22, Block 209, requesting permission to construct proposed 2-story addition and deck onto

          the existing single family dwelling on property located in a R-3 Zone District, requiring Variance

          relief from minimum rear yard setback (deck) (dwelling), maximum principal building coverage

          and maximum impervious coverage was approved subject to certain conditions. Action to be

          memorialized at a later date.

        CASE NO. Z-05-33- Zoning Appeal and Variance Application of Gerald J. and Susan Caccappolo,

        1 Highview Terrace, Madison, Block 4205, Lot 5, to reverse the action of the Code Enforcement

        Official and a Variance Application filed seeking variance relief from Code Section 19.5-25.5B of

        the Land Development Regulations of the Borough of Madison to grant variance relief to allow a

        6 ft. high fence to remain on the property in the front yard (corner of property) located at 1 Highview

        Terrace, designated on the Borough Tax Map as Lot 5, Block 4205 in a R-2 Zone District was

        carried to the Wednesday, September 28, 2005 special meeting  for the initial public hearing.

        No further notice is required.

 

        CASE NO. Z-05-35- Variance Application of Martin and Danielle Barbato, Block 3901, Lot 52,

        6 Arlena Court, Madison requesting permission to construct proposed front Stoop with Overhang

        over the front Door platform on property located in a R-3 Zone District, requiring Variance relief

        from the minimum front yard setback was carried to the Wednesday, September 28, 2005 special

        meeting for the initial public hearing. No further notice is required.

 

        CASE NO. Z-05-36- Variance Application of Doug and Nancy Willis, Block 4004, Lot 25, 183

        Woodland Road, Madison, requesting permission to demolish existing garage and reposition new

        garage and driveway modifications and to construct a 300 sq. ft. addition on the existing single

        family dwelling on property located in a R-1 Zone District, requiring Variance relief from minimum

        side yard setback, maximum impervious coverage and maximum principal building coverage was

        carried to the Wednesday, September 28, 2005 special meeting for the initial public hearing.

        CASE NO. Z-05-37-Variance Application of Stephen and Barbara McKenna, Block 1301, Lot 5,

        44 Elm Street, Madison requesting permission to construct proposed 2nd story addition to existing

        single family residential dwelling on property located in a R-3 Zone District, requiring Variance

        relief from minimum front yard setback was carried to the Wednesday, September 28, 2005

        special meeting for the initial public hearing. No further notice is required.

 

        CASE NO. Z-05-38- Variance Application of Lawrence P. and Julie A. Pedersen, Block 4502,

        Lot 25, 82 Shunpike Road, Madison to erect a wooden deck in the rear yard on property located

        in a R-2 Zone District, requiring Variance relief from minimum rear yard setback requirements was

        carried to the Wednesday, September 28, 2005 special meeting for the initial public hearing.

       CASE NO. Z-05-39- Variance Application of Paul and Tara Canfield, Block 901, Lot 2, 127

       Greenwood Avenue, requesting permission to construct proposed 2nd Story Addition to the existing

 dwelling to add one bedroom and full bathroom on the Second Story and expand kitchen and add a family room on first floor and a Wood Deck on property located in a R-3 Zone District, requiring Variance relief from the maximum principal building coverage and maximum impervious coverage requirements was carried to the Wednesday, September 28, 2005 special meeting for the initial public hearing. No further notice is required.

 

CASE NO. Z-05-40- Variance Application of Rajesh Talpade, Block 2306, Lot 5, 17 Delbarton

Drive requesting permission to construct proposed 1 story addition, 2nd story addition and wood

deck on property located in a R-3 Zone District, requiring Variance relief from the maximum

      principal building coverage requirements was carried to the Wednesday, September 28, 2005

      special meeting  for the initial public hearing. No further notice is required.

      CASE NO. Z-05-41- Variance Application of Jon and Christine Anderson, Block 4703, Lot 12,

       8 Broadview Avenue, requesting permission to construct proposed 2nd Story Addition for use

       as a bedroom area and bedroom-attic area in the new roof structure and the relocation and

       reconstruction of the existing deck, that will place the deck more central to the house and

       rear yard area. The property is located in a R-2 Zone District, requiring Variance relief from

       the minimum side yard setback and minimum rear yard setback requirements was carried to

       the Wednesday, September 28, 2005 special meeting for the initial public hearing. No

       further notice is required.

 

       CASE NO. Z-05-42- Variance Application of Samuel and Theresa Romano, Block 4001, Lot 25,

       29 West Lane requesting permission to construct proposed 2 ˝ Story Single Family Dwelling

       on property located in a R-2 Zone District, requiring Variance relief from the minimum side

       yard setback and maximum “Moderate” Slope Disturbance requirements was carried to the

       Wednesday, September 28, 2005 special meeting for the initial public hearing. No further

        notice is required.

     

       CASE NO. Z-05-43- Variance Application of Patrick J. and Sharon W. Farrell, Block 4001, Lot 33,

       65 West Lane, requesting permission for the proposed expansion of existing attached Garage and

       proposed front Stoop with Overhang on property located in a R-2 Zone District, requiring Variance

       relief from the minimum front yard setback requirements was carried and is scheduled for initial

       public hearing at the Thursday, September 29, 2005 special meeting at the request of the

       applicant. No further notice is required.

 

       CASE NO. Z-05-44 –Zoning Appeal and Variance Application of Russell Bird, Block 707, Lot 45,

       216 Greenwood Avenue, requesting variance relief to allow the existing six-foot high fence to

       remain as it is presently situated, which is in violation of  Section 195-25.5.B of the Land

       Development Code of Madison Borough. That section of the Code reads in part, “Any fence over

       four feet in height shall not be located closer to the front line than the rear building line of the

       principal structure”. The subject property is located in a R-3 Zone District. The application was

       carried to the Wednesday, September 28, 2005 special meeting  for the initial public hearing.

       No further notice is required.

  

        CASE NO. Z-05-45- Variance Application of Stephen C. and Laurie G. Morrison, Block 309,

        Lot 13, 10 Rose Avenue, requesting permission to construct the proposed 2-story addition to expand

        present kitchen on the first floor and bathroom, which is above the current kitchen on property

        located in a R-3 Zone District, requiring Variance relief from the maximum principal building

        coverage and maximum impervious lot coverage was carried to the Wednesday, September 28,

        2005 special meeting  for the initial public hearing. No further notice is required.

 

       CASE NO. Z-05-46- Variance Application of Ralph and Barbara Romano, Block 2306, Lot 4,

       19 Delbarton Drive, requesting permission to construct the proposed 1-story rear kitchen addition

       onto the existing single family dwelling on property located in a R-3 Zone District, requiring

       Variance relief from the maximum principal building coverage was carried to the Wednesday,

       September 28, 2005 special meeting for the initial public hearing. No further notice is required.
