MADISON ZONING BOARD OF ADJUSTMENT NOTICE OF DECISIONS

PLEASE TAKE NOTICE, that at a regular meeting of the Zoning Board of Adjustment of the Borough of Madison held on Wednesday, August 10, 2005 at 7:30 PM, in the Board Room of the Hartley Dodge Memorial, Kings Road, Madison, the following action was taken:

 

Approval of Minutes- Regular Meeting Minutes of 7/19/2005 was adopted as corrected.

 

       RESOLUTIONS

            CASE NO. Z-05-20-Resolution granting the Application of Gregory Saint-James Vigeant as

             Applicant and Owner for Variance Approval to allow improved, exact replacement four foot high

            fence to remain in place in the front yard (Spring Garden Drive, corner of Rosedale Avenue)

            on property located at 1 Spring Garden Drive, Madison, designated on the Borough Tax Map as

             Lot 6, Block 2204 was adopted.

      

       CASE NO. Z-05-22-Resolution granting the Application of Thomas and Pamela Giannone as

       Applicant and Owner for Variance Approval to construct proposed 1st story Cantilevered

       Principal Building Addition onto the existing dwelling on property located at 44 Green Avenue,

       designated on the Borough Tax Map as Lot 9,  Block 3701 was adopted.

        

             CASE NO. Z-05-26-Resolution granting the Application of Brian and Laura Agnew as Applicant

             and Owner for Variance Approval to construct a new 2-1/2 Story Dwelling on property located at

            15 East Lane, Madison, designated on the Borough Tax Map as Block 4003, Lot 6 was adopted.

      

            CASE NO. Z-05-28-Resolution granting the Application of Kim Christiansen as Applicant and

            Owner for Variance Approval to construct proposed second story and modification to existing

            front stoop overhang onto the existing dwelling on property located at 11 Fairwood Road,

            designated on the Borough Tax Map as Lot 22, Block 0208 was adopted.

 

            OLD BUSINESS

           CASE NO. Z-05-25-Variance Application of William D. Vaughan, Block 910, Lot 6, 6 Hamilton

           Street, Madison requesting permission to construct proposed 1 story addition and 2nd story

           Addition to increase the bedrooms to three and to add an additional bathroom to the existing

           single family dwelling on property located in a R-3 Zone District, requiring Variance relief from

           the minimum rear yard setback and maximum impervious lot coverage was approved subject to

           certain conditions. Action to be memorialized at a later date.

 

           CASE NO. Z-05-29 Variance Application of Patrick & Heather Shields, Block 209, Lot 5.08,

           11 Wisteria Court, Madison requesting permission to construct a two-story front addition with

           covered porch and entry portico, a two-story rear addition and to rebuild an existing deck to the

           existing single family dwelling on property located in a R-3 Zone District, requiring Variance

           relief from minimum front yard setback, minimum rear yard setback and maximum impervious

           coverage was approved subject to certain conditions. Action to be memorialized at a later date.

 

          CASE NO. Z-05-30 Variance Application of Richard DeSalvo, Block 209, Lot 5.22,                           

          9 Baumgartner Drive, Madison requesting permission to construct proposed 2-story addition and

          deck onto the existing single family dwelling on property located in a R-3 Zone District, requiring

          Variance relief from minimum rear yard setback (deck) (dwelling), maximum principal building

          coverage and maximum impervious coverage was partially heard and carried to the September

          19, 2005 meeting for submission of revised plans and further proceedings. No further notice is

          required.

         CASE NO. Z-05-32 Variance Application of James and Rose Mikula, Block 101, Lot 22,

         41 Shadylawn Drive, Madison requesting permission to construct proposed dormer, which will be

         in line with the existing dormers on the existing structure on property located in a R-3 Zone District,

         requiring Variance relief from minimum front yard setback was approved subject to certain

         conditions. Action to be memorialized at a later date.

 

         CASE NO. Z-05-34 Variance Application of Larry and Linda O’Gorman, Block 3805, Lot 10,

         18 Albright Circle, Madison requesting permission to construct proposed 2nd story addition on the

         existing structure on property located in a R-2 Zone District, requiring Variance relief from the

         minimum front yard setback was carried to the Monday, September 19 , 2005 meeting for the

         initial public hearing. No further notice is required.

 

        NEW BUSINESS

        CASE NO. Z-05-27- Application of Louis and Patricia DeBiasse, Block 2101, Lot 18, 34 Lewis

        Drive, Madison, filed as Zoning Appeal and Variance Application and request for Waiver of Parking

        Site Plan Details or other relief so as to Appeal the Decision of the Zoning Officer and obtain relief

        from the accessory use and conditional use requirements to relocate the applicant’s existing

        professional dental practice from Hamilton Street to 34 Lewis Drive, which generates medical waste;

        and to obtain relief to exceed the maximum impervious coverage limitation of the zoning regulations

        in the R-2, Single Family Residential Zone District was carried to the Monday, September 19,

        2005 meeting for the initial public hearing. No further notice is required.

      

        CASE NO. Z-05-33- Application of Gerald J. and Susan Caccappolo, Block 4205, Lot 5, 

        1 Highview Terrace, Madison, as a Zoning Appeal to reverse the action of the Code Enforcement

        Official and a Variance Application filed seeking variance relief from Code Section 19.5-25.5B of

        the Land Development Regulations of the Borough of Madison to grant variance relief to allow a

        6 ft. high fence to remain on the property in the front yard (corner of property) located at 1 Highview

        Terrace, designated on the Borough Tax Map as Lot 5, Block 4205 in a R-2 Zone District was

        carried to the Monday, September 19, 2005 meeting  for the initial public hearing at the

        request of the applicant. No further notice is required.

 

        CASE NO. Z-05-35- Variance Application of Martin and Danielle Barbato, Block 3901, Lot 52,

        6 Arlena Court, Madison requesting permission to construct proposed front Stoop with Overhang

        over the front Door platform on property located in a R-3 Zone District, requiring Variance relief

        from the minimum front yard setback was carried to the Monday, September 19, 2005 meeting

        for the initial public hearing. No further notice is required.

 

        CASE NO. Z-05-36- Variance Application of Doug and Nancy Willis, Block 4004, Lot 25, 183

        Woodland Road, Madison, requesting permission to demolish existing garage and reposition new

        garage and driveway modifications and to construct a 300 sq. ft. addition on the existing single

        family dwelling on property located in a R-1 Zone District, requiring Variance relief from minimum

        side yard setback, maximum impervious coverage and maximum principal building coverage was

        carried to the Monday, September 19, 2005 meeting for the initial public hearing. No further

        notice is required.

 

        CASE NO. Z-05-37-Variance Application of Stephen and Barbara McKenna, Block 1301, Lot 5,

        44 Elm Street, Madison requesting permission to construct proposed 2nd story addition to existing

        single family residential dwelling on property located in a R-3 Zone District, requiring Variance

        relief from minimum front yard setback was carried to the Monday, September 19, 2005 meeting

        for the initial public hearing. No further notice is required.

        in a R-2 Zone District, requiring Variance relief from minimum rear yard setback requirements was

        carried to the Monday, September 19, 2005 meeting for the initial public hearing. No further
