MADISON ZONING BOARD OF ADJUSTMENT NOTICE OF DECISIONS

 

NOTICE IS HEREBY GIVEN, that at a regular meeting of the Zoning Board of Adjustment of the Borough of Madison, held on Thursday, January 13, 2005 at 7:30 PM, in the Board Room of the Hartley Dodge Memorial Building, Kings Road, Madison, New Jersey, the following action was taken:

 

            Approval of Minutes- Regular meeting minutes 12/06/04 was approved with minor revisions.

 

RESOLUTIONS FOR MEMORIALIZATION

CASE NO. Z-04-48- Resolution approving the Application of Mary Lou Salko, Block 3802, Lot 9,

2 Keep Street, Madison was adopted.

 

CASE NO. Z-04-49-Resolution approving the Application of Brent and Nancy Phillippi, Block 4301,

Lot 26, 49 Lathrop Avenue, Madison was adopted.

 

CASE NO. Z-04-50-Resolution approving the Application of Karen Suchenski, Block 0302, Lot 10,

28 Redmond Drive, Madison was adopted.

                    

             OLD BUSINESS

       CASE NO. Z-02-50 – Application of Anthony and Fredericka LoSapio, Block 1203, Lot 8, 8 Kinney

       Street, Madison to construct a one and two-story addition onto the existing dwelling for use as a

       two-family dwelling in a R-4,Two Family Residential Zone District. The property is located at 8 Kinney

       Street and designated on the Borough Tax Map as Lot 8 in Block 1203. The public hearing on the

       application was partially heard and carried to the Tuesday, February 15, 2005 meeting for consideration

       by the applicant to revise the plans and for further proceedings. No further  notice is required. 

 

       CASE NO. Z-04-35- Application of Anthony S. Montagna  in Block 3802, Lot 6 , 30 1/2 Prospect Street,

        Madison for a Conditional Use and Variance Approval to use the existing site as a Professional Office

        and residential apartment located in an R-4 Zone District. The application does not meet all of the

        requirements necessary for this conditional use contained in Ordinance 195-33B(1), more specifically,

       Section 195-33B(1)(b) that the practitioner must reside in the home and Section 195-33B(1) d that states

       the home occupation shall not occupy more than 50% of the total area of the floor where located, excluding

       space used for a private garage or 900 square feet, whichever is smaller. These are (d) variances. The

       proceedings on the application was carried to the Tuesday, February 15, 2005 meeting at the request

       of the applicant’s attorney. Full statutory notice is required in order to reopen proceedings on this

       application.

      

       CASE NO. Z-03-57- Application of Robert Lyszczarz, Block 2401, Lot 1, 221 Main Street, for

       Preliminary and Final Site Plan Approval, Use Variance and Dimensional Variances to convert an existing

       three-family dwelling into an office building and to construct an 880-sq.ft. addition to the existing structure

       to be occupied by a single tenant (Real Estate Office) on the ground floor and an apartment on the second

       floor. To remove existing garage and construct an eight-car parking lot located in the CC (Community

       Commercial) Zone District. The hearing on the application was resumed but not concluded. The applicant

       will submit revised plans with the proposed changes presented at the January 13th hearing at the

       next scheduled  meeting on Tuesday, February 15, 2005. The Board may take formal action at the

       February meeting after review of revised plans.

 

       CASE NO. Z-04-46 Application of 275 Main Street Inc. d/b/a Madison Jaguar, Block 2402, Lot 20,

       275 Main Street, Madison for Notice of Appeal, request for interpretation and application for development,

        including (d) variances. The appeal/application concerns the following locations: 126 Main Street, Block

       1803, Lot 15, 134 Main Street, Block 1803, Lot 16, 275 Main Street, Block 2402, Lot 20, 306 Main Street,

       Block 2208, Lot 27 and 340 Main Street, Block 2302, Lot 22. The proceedings on the application/appeal

       was adjourned to Tuesday, February 15, 2005 per the request of the applicant’s attorney. Full

       statutory notice is required in order to proceed with the application.

CASE NO. Z-04-47 Application of Cellular Telephone Company d/b/a AT & T Wireless as Applicant and the

       Housing Authority of the Borough of Madison as Owner for Preliminary and Final Site Plan Approval,

       Use Variance and Height Variances to install twelve (12) telecommunication antennas, one (1) E911

       GPS antenna and related equipment on the rooftop of the existing 4-story Senior Citizen apartment

       Building. The property is located at 15 Chateau Thierry Avenue and designated on the Borough Tax Map

       as Block 402, Lot 1.01 located in a (R-SH) Senior Citizen Housing) Zone District. The hearing on the

       application was started but not concluded. It was carried to the Tuesday, February 15, 2005

       meeting for further proceedings. No further notice is  required.    

    

      NEW BUSINESS

     CASE NO. Z-04-51-Application of Larry and Donna Bland, Block 4103, Lot 6,12 Harwood Drive,

     Madison requesting permission to construct a 1 story addition, attached two car garage, Bluestone

     Patio, Wood Deck, Front and Rear Bay Windows, Front Stoop with Overhang, Realignment and

     Expansion of Existing Driveway on property located in a R-1 Zone District, requiring Variance relief

     for minimum front yard setback was carried to Tuesday, February 15, 2005. No further notice is

     required.

 

    CASE NO. Z-04-52 Application of Michael and Suzanne Graham, Block 0304, Lot 14, 14 Page

    Street, Madison requesting permission to construct a 2 story addition on property located in a R-3

    Zone District, requiring Variance relief for maximum principal building coverage was carried to

    Tuesday, February 15, 2005. No further notice is required.

  

    CASE NO. Z-04-53 Application of Andrew Podberezniak and Frank Frances, Block 3901, Lot 13,

    221 Kings Road requesting permission to construct a 2nd story addition to add (3) bedrooms and a

    bathroom on property located in a R-3 Zone District, requiring Variance relief for minimum front yard

    setback, maximum rear yard setback and maximum impervious coverage was carried to Tuesday,

    February 15, 2005. No further notice is required.

 

     CASE NO. Z-04-54 Application of Mark and Laura Burgess, Block 0209, Lot 5.09, 9 Wisteria Court

     requesting permission to construct an open air covered porch and wood deck on property located in a

     R-3 Zone District, requiring Variance relief for minimum rear yard setback and maximum impervious

     Coverage was carried to Tuesday, February 15, 2005. No further notice is required.
