MADISON ZONING BOARD OF ADJUSTMENT

    NOTICE OF DECISIONS

 

NOTICE IS HEREBY GIVEN, that at a regular meeting of the Zoning Board of Adjustment of the Borough of Madison, held on Monday, November 15, 2004, at 7:30 PM, in the Board Room of the Hartley Dodge Memorial Building, Kings Road, Madison, New Jersey, the following action was taken:

 

           Approval of Minutes- Regular meeting minutes 9/20/04 was approved with minor

           corrections and the Regular meeting minutes 10/18/04 was approved as submitted.

 

RESOLUTIONS FOR MEMORIALIZATION

            CASE NO. Z-04-37- Resolution approving the Variance Application of John and Paige Henry, Block

            3001, Lot 28, 7 Stafford Drive was adopted.

 

            CASE NO. Z-04-38- Resolution approving the Variance Application of Peter and Gerarda Kuiper, Block

            3702, Lot 41, 79 Prospect Street was adopted.

 

            CASE NO. Z-04-39- Resolution approving the Variance Application of Sean and Christine Tully, Block

            4501, Lot 6, 246 Green Village Road was adopted.

 

            CASE NO. Z-04-41 – Resolution approving the Variance Application of Paul and Diana Daly, Block

            0905, Lot 8, 32 Longview Avenue was adopted. 

 

            DISCUSSION ON MINOR PLAN CHANGE

             CASE NO. Z-03-49  Revised Plans for Dave Pavlisko, Block 311, Lot 10,  33 Pine Avenue was approved,

            as the board determined the plans were consistent with the prior approval.

            

            OLD BUSINESS

     CASE NO. Z-03-57- Application of Robert Lyszczarz, Block 2401, Lot 1, 221 Main Street, for Preliminary

     and Final Site Plan Approval, Use Variance and Dimensional Variances to convert an existing three-family

     dwelling into an office building and to construct an 880-sq.ft. addition to the existing structure to be

     occupied by a single tenant (Real Estate Office) on the ground floor and an apartment on the second

     floor. To remove existing garage and construct an eight-car parking lot located in the CC (Community

     Commercial) Zone District. The variances being requested are for maximum building height, minimum lot

     width (corner lot), minimum front yard (corner lot) and the maximum F.A.R. being proposed requires a "d"

      variance. The hearing on the application was resumed and carried to Monday, December 6, 2004 for

     submission of revised  plans and continuation of public hearing. The applicant is required to publish notice

     of the new continued public hearing date and to re-serve notice to the property owners within 200’ of the

     subject property.   

 

OLD BUSINESS

CASE NO. Z-04-35

       Anthony S. Montagna

       Block 3802, Lot 6

       30 1/2 Prospect Street

Application for a Conditional Use and Variance Approval to use the existing site as a Professional Office and residential apartment located in a R-4 Zone District. The application does not meet all of the requirements necessary for this conditional use contained in the Madison Borough Ordinance 195-33B(1), more specifically, Section 195-33B(1)(b) that the practitioner must reside in the home and Section 195-33B(1)d that states the home occupation shall not occupy more than 50% of the total area of the floor where located, excluding space used for a private garage or 900 square feet, whichever is smaller. The application was carried to Monday, January 3, 2005 at the request of the applicant’s attorney for further proceedings. The hearing is subject to the submission of an amended application. The applicant is required to Publish Notice of the new hearing date and to re-serve Notice to the property owners within 200 feet of the subject property.  

 

 

 

CASE NO. Z-04-34

            Gayle DeSimone

            Block 4308, Lot 7

            Alma Avenue

Application requesting permission to construct a 2 story dwelling located in a R-3 Zone District, requiring Variance relief for maximum principal building coverage and minimum side yard setback. This application was carried to Monday, December 6, 2004 at the request of the applicant’s attorney. No further notice is required.

 

NEW BUSINESS

CASE NO. Z-04-42–Application of Christopher and Deanna Schraft, Block 4903, Lot 11,

26 Dellwood Parkway South, requiring variances for rear yard setback, impervious coverage and principal building coverage was approved subject to certain conditions.

        

            NEW BUSINESS- CASE NO. Z-04-43- Application of Christopher and Allison Lutz, Block 4205,

            Lot 8, 11 Highview Terrace requesting permission to erect a one-story addition at the back of the existing

             house and a second story addition on the right side of the house and to remove a stone patio with a new

             wood deck requiring variance relief for minimum front yard setback, minimum side yard setback (right),

             maximum impervious coverage and maximum principal building coverage was approved subject to certain

             conditions..

 

      CASE NO. Z-04-44- Application of Thomas and Jennifer McDole, Block 3907, Lot 7, 273 Kings Road,

      requesting permission to construct a 2nd story addition over existing garage for bedroom living space  

      requiring variance relief for minimum front yard setback (Arlena Court) (Kings Road) was approved

      subject to certain conditions. 

  

       CASE NO. Z-04-45—Application of James Monoghan and Lauren Rizzuto Monoghan, Block 1101,

       Lot 17, 15 Wayne Boulevard  requesting permission to construct a 2nd story cantilevered addition onto the

       existing house, requiring variance relief for minimum front yard setback was approved subject to certain

       conditions.
