NOTICE OF DECISIONS

 

NOTICE IS HEREBY GIVEN, that at a regular meeting of the Zoning Board of Adjustment

of the Borough of Madison, held on Tuesday, June 22, 2004, at 7:30 PM, in the Board Room

of the Hartley Dodge Memorial Building, Kings Road, Madison, New Jersey, the following

action was taken:

 

             Minutes for Approval

            Special Meeting Minutes for 06/15/04 was adopted as corrected.

 

            RESOLUTIONS FOR MEMORIALIZATION AND ROLL CALL VOTE

             CASE NO. Z-04-11 Resolution approving the Application of Vendel & Ellen Kovach,

             Block 3901, Lot 50,10 Arlena Court, Madison was adopted.

 

            CASE NO. Z-04-13  Resolution approving the Application of Michael and Christine Mullen,

            Block 1004, Lot 16.2, 165 Central Avenue, Madison was adopted.

 

            CASE NO. Z-04-16 Resolution approving the Application of Stephen P. Adamowitz,

            Block 0701, Lot 3, 12 Valevue Avenue, Madison was adopted.

 

            CASE NO. Z-04-17 Resolution approving the Application of Robert and Martha Baisch,

            Block 3601, Lot 26, 24 Hillside Avenue, Madison was adopted.

 

            CASE NO. Z-04-18 Resolution approving the Application of Carmine DeCaro, Block 1101,

            Lot 4, 41 Park Avenue, Madison was adopted.

 

            CASE NO. Z-04-19 Resolution approving the Application of Edwin A. Boyer, Block 4503,

            Lot 6, 12 Candlewood Drive, Madison was adopted.

 

            CASE NO. Z-04-21 Resolution approving the Application of Steve Sherman and Deanna

            Schwarz, Block 3001, Lot 24, 41 Green Village Road, Madison was adopted.

 

            OLD BUSINESS

            CASE NO. Z-04-10 Application of Doug and Melissa Griffie, Block 1001, Lot 49,

            138 Central Avenue requesting permission to construct a 1 and 2 story addition

            (attaching existing detached Garage to existing Principal Structure), proposed 2nd story

            addition to Principal Structure, proposed 2nd story addition to existing Garage, proposed Wood

            Deck on property located in a R-3 Zone District, requiring a variance for minimum side

            yard setback (Garage) (Deck) and maximum impervious coverage. The application was

            approved subject to certain conditions and the submission of a revised plan for review and

            approval by the Board Attorney. Action to be memorialized at the next meeting.

 

           CASE NO. Z-04-06- Application of Bruce D. MacDougall, Block 1001, Lot 30,

           68 Central Avenue, Madison for the conversion of a building containing one dwelling unit

           and a plumbing business to a two-family dwelling. The area previously occupied by the

           plumbing business was converted, without benefit of necessary approvals, to a residential unit

           in or about 1993. The applicant seeks relief from the minimum lot area and width requirements

           in the R-4 Zone District. The application was carried at the request of the applicant to the next

           regular meeting on Tuesday, July 20, 2004. No further notice is required.

Regular Meeting

   

      CASE NO. Z-04-23 Application of William and Joan Johnson, Block 3601, Lot 32,

      14 Green Hill Road, Madison to construct a one-story addition, front porch, deck and detached

      garage located in a R-2 Zone District, requiring a Variance for minimum side yard setback,

      maximum principal building coverage, maximum impervious coverage and maximum

      accessory structure height was partially heard and carried to Tuesday, July 20, 2004.

      The applicant requested the adjournment for consideration of a revised proposal, with

      revised plans to be submitted 10 days in advance. No further notice required.

 

      CASE NO. Z-03-57- Application of Robert Lyszczarz, Block 2401, Lot 1, 221 Main Street for

      Preliminary and Final Site Plan Approval, Use ("d") Variance and Dimensional Variances to

      convert an existing three-family dwelling into an office building and to construct a 880-sq.ft.

      addition to the existing structure to be occupied by a single tenant (Real Estate Office). To remove

      existing garage and construct an eight-car parking lot located in the CC (Community Commercial)

      Zone District. The variances being requested are for maximum building height, minimum lot width

      (corner lot), minimum front yard (corner lot) and the maximum F.A.R. being proposed requires

      a "d" variance for being 50% over the requirement, and variance approval for the proposed signage.

      The hearing was started, but not concluded and carried to the Tuesday, July 20, 2004 meeting.

      The resumption of proceedings at the July 20 meeting will be dependent on whether the applicant

      is prepared to proceed with an appropriate presentation. No further notice is required.

          

      CASE NO. Z-04-24- Application of Matthew S. and Susan K. Gann, Block 2208, Lot 6,

       41 Spring Garden Drive, Madison to construct a wood deck above the existing patio

       in the backyard. The proposed deck would be attached to the 2nd level of the house on

      property located in a R-3 Zone District, requiring variance relief for minimum side

      yard setback and minimum rear yard setback. The application was approved subject to

      certain conditions and the submission of a revised plan for review and approval by the

     Board Attorney. Action to be memorialized at the next meeting.

 

      CASE NO. Z-04-25 Application of Gary and Karen Deeb, Block 0209, Lot 5.17,

      8 Baumgartner Drive, Madison to construct a 8' x 12' one story rear Kitchen addition,

      overhang and bay window on property located in a R-3 Zone District, requiring variance relief

      for minimum rear yard setback, maximum principal building coverage and maximum impervious

      coverage was approved subject to certain conditions. The application was approved subject to

     certain conditions and the submission of a revised plan for review and approval by the Board

     Attorney. Action to be memorialized at the next meeting.

 

      CASE NO. Z-04-26 Application of Leslie and Kathleen Hollander, Block 4804, Lot 15,

      14 Barnsdale Road, Madison to construct a one-story addition, second story addition, Front

      Foyer, 2-level deck and Brick Paver Walkway on property located in a R-2 Zone District,

      requiring variance relief for minimum side yard setback and maximum principal building

      coverage was carried to Tuesday, July 20, 2004. No further notice is required.

 

      CASE NO. Z-04-27 Application of Michael and Katherine Dailey, Block 0803, Lot 3,

      20 West End Avenue, Madison to construct a second story addition, one-story addition

      and Flag Stone Patio on property located in a R-3 Zone District, requiring Variance relief

      for maximum principal building coverage. The application was carried to Tuesday, July 20,

      2004. No further notice is required.

Regular Meeting

 

      CASE NO. Z-04-28 Application of Carmine Toto, Jr. and Michael Toto, Block 3802, Lot 69,

      23 Albright Circle, Madison to demolish existing dwelling and erect a new two-story dwelling

      on property located in a R-2 Zone District, requiring Variance relief for minimum lot width.

      The application was dismissed based on a memorandum from the Zoning Enforcement Officer,

      Daniel Buckelew rescinding the prior zoning denial based on Section 195-36(G) of the Land

      Development Ordinance of the Borough of Madison.

 

      CASE NO. Z-04-29 Application of Daniel and Madeline Baulig, Block 0906, Lot 9, 8 Longview

      Avenue, Madison to construct a second story addition on property located in a R-3 Zone District,

      requiring Variance relief for minimum front yard setback was carried to Tuesday, July 20, 2004.

      No further notice required.
