NOTICE OF DECISIONS

 

NOTICE IS HEREBY GIVEN, that at a regular meeting of the Zoning Board of Adjustment

of the Borough of Madison, held on Monday, May 17, 2004 , at 7:30 PM , in the Board Room

of the Hartley Dodge Memorial Building , Kings Road , Madison , New Jersey , the following

action was taken:

 

            Minutes for Approval

           Regular Meeting Minutes for 04/19/04 was adopted as submitted.

           

           RESOLUTION FOR MEMORIALIZATION AND ROLL CALL VOTE

            CASE NO. Z-04-09  In the Matter of the Application of Jeffrey and Christine Schermerhorn,

           Block 3802, Lot 18, 22 Keep Street was adopted.

 

          ITEMS FOR DISCUSSION

         

          CASE NO. Z-03-41- Application of Madison Honda, Block 2208, Lots 23,24

          and 25, 280 Main Street . The application was adjourned to the special meeting

          on May 26, 2004 . The Board will discuss the status of the application at that meeting.

     

         CASE NO. Z-03-46- In the Matter of the Application of Thomas and Katherine Salko,

         Block 901, Lot 4,123 Greenwood Avenue . The Board determined that the revised plans

         dated February 5, 2004 did not impair the prior variance approval and are consistent with

          the prior variance approval. There was no need for amended approval proceedings or an

         amended resolution. The Board's action will be confirmed by a memorandum to the

         Construction Official.    

      

        OLD BUSINESS

       

        CASE NO. Z-04-05 Application of Anthony S. and Carmen Montagna, Block 0505, Lot 27,

        2 Burnet Road , for the construction of a "deck and sun porch (enclosed)" addition on property

        located in a R-3 Zone District, requiring a variance for minimum side yard setback, minimum

        rear yard setback, and maximum principal building coverage and maximum impervious coverage.

        The application was approved subject to certain conditions. Action to be memorialized at the

        next meeting.    

 

       CASE NO. Z-04-07 Application of Jonathan & Suzanne Shelby, Block 4102, Lot 2,

       77 Midwood Terrace to construct a one-story addition, 2nd story addition, enclosure of existing sun

       porch, front porch and expansion of existing driveway on property located in a R-1 Zone District,

       requiring a variance for minimum side yard setback, maximum impervious coverage, maximum

       principal building coverage and unenclosed porch encroachment. The application was partially heard

       and carried to the special meeting on May 26, 2004 for presentation of revised plans.  

 

     CASE NO. Z-04-01 Application of Richard A. and Jeanne E. Gradone, Block 0307, Lot 16,

     9 Crestwood Drive for the construction of a two-story addition in place of an existing front patio

     and existing garage on property located in a R-3 Zone District, requiring a variance for minimum

     front yard setback and maximum principal building coverage. The application was approved subject

     to certain conditions. Action to be memorialized at the next meeting.

   CASE NO. Z-04-06 Application of Bruce D. MacDougall, Block 1001, Lot 30,

    68 Central Avenue for the conversion of a building containing one (1) dwelling unit

    and a plumbing business to a two-family dwelling. The area previously occupied by the

    plumbing business was converted, without benefit of necessary approvals, to a residential unit

    in or about 1993. The applicant seeks relief from the minimum lot area and width requirements

    in the R-4 Zone District. The application was partially heard and carried to the next regular meeting

   on June 21, 2004 for submission of revised plans. Plans must be submitted at least ten days prior to

   the meeting date.

 

  CASE NO. Z-04-08 Application of Theresa Christie, Block 4903, Lot 10, 6 Dellwood Parkway

  South to construct a "Pool House" which is an "Accessory Structure" within the "Front Yard" on

  property located in a R-1 Zone District, requiring relief from Section 195-30.5B(4) of the Land Use

  Code of the Borough of Madison . The application was approved subject to certain conditions. Action

  to be memorialized at the next meeting.

 

  CASE NO. Z-04-10 Application of Doug and Melissa Griffie, Block 1001, Lot 49, 138 Central

  Avenue to construct a 1 and 2 story addition (attaching existing detached Garage to existing Principal

  Structure), proposed 2nd story addition to Principal Structure, proposed 2nd story addition to existing

  Garage, proposed Wood Deck on property located in a R-3 Zone District, requiring a variance for

  minimum side yard setback (Garage) (Deck) and maximum impervious coverage was carried to the

  special meeting on May 26, 2004 . No further notice required.

 

  CASE NO. Z-04-11 Application of Vendel & Ellen Kovach, Block 3901, Lot 50, 10 Arlena Court

  to maintain the existing enclosed porch (constructed without Zoning & Construction Reviews & Permits)

  on property located in a R-3 Zone District, requiring a variance for minimum rear yard setback,

  maximum principal building coverage, maximum impervious coverage was carried to the special

  meeting on May 26, 2004 . No further notice required.  

 

  CASE NO. Z-04-12- Application of Ronald and Jennifer Boyer, Block 0906, Lot 8, 10 Longview

  Avenue to construct a one-story addition for a Family Room and full bathroom to an existing dwelling

  located in a R-3 Zone District, was carried to the special meeting on May 26, 2004 . No further notice

  required.

 

   CASE NO. Z-04-13- Application of Michael and Christine Mullen, Block 1004, Lot 16.2

   165 Central Avenue to construct a one-story addition and 2nd story addition primarily in place of

   existing deck in rear yard to re-design the kitchen to allow for more efficient use of space and to

   expand dining room to accommodate the applicant's family. The property is located in a R-3 Zone

   District, was carried to the special meeting on May 26, 2004 . No further notice required.  

 

   CASE NO. Z-04-14- Application of Fred and Jane Thierman, Block 0804, Lot 2,

   11 Leigh Drive to construct a 2nd story addition, Portico and Bay Window to the existing dwelling

   located in a R-3 Zone District, was carried to the special meeting on May 26, 2004 No further

   notice required.

 

   CASE NO. Z-04-15- Application of David and Michele Johnson, Block 3101, Lot 28,

   4 Ross Court to construct a second story addition to an existing structure located in a R-3 Zone

CASE NO. Z-03-57 Application of Robert Lyszczarz, Block 2401, Lot 1, 221 Main Street , for

Preliminary and Final Site Plan Approval, Use Variance and Dimensional Variances to convert an

existing three-family dwelling into an office building and to construct a 880-sq.ft. addition to the

existing structure to be occupied by a single tenant (Real Estate Office). To remove existing garage

and construct an eight-car parking lot located in the CC (Community Commercial) Zone District.

The variances being requested are for maximum building height, minimum lot width (corner lot),

minimum front yard (corner lot) and the maximum F.A.R. being proposed requires a "d" variance

for being 50% over the requirement, and variance approval for the proposed signage. The application

is being deferred pending the filing of all materials required for Zoning Board submission. Upon

receipt of the materials, the application can be deemed administratively complete and this office

can schedule a new assigned hearing date.

              

OTHER BUSINESS

Resolution Approving New By-Laws for the Madison Borough Zoning Board of Adjustment

was adopted.
