NOTICE OF DECISIONS

 

NOTICE IS HEREBY GIVEN, that at a regular meeting of the Zoning Board of Adjustment

of the Borough of Madison, held on Monday, March 15, 2004, at 7:30 PM, in the Board Room

of the Hartley Dodge Memorial Building, Kings Road, Madison, New Jersey, the following

action was taken:

 

            Minutes for Approval

           Regular Meeting Minutes for 02/02/04 was adopted as submitted.

 

           RESOLUTION FOR MEMORIALIZATION AND ROLL CALL VOTE

           CASE NO. Z-03-53- Resolution denying the Application of Arkadiusc Maluszcak,

           Block 601, Lot 1, 150 Ridgedale Avenue was adopted.

           

           OLD BUSINESS    

           CASE NO. Z-03-54-Application of Sean and Michelle Flanagan, Block 0103, Lot 26,

           6 Shadylawn Drive, Madison was withdrawn by the applicant.

 

           CLARIFICATION OF PRIOR APPROVAL RESOLUTION

           CASE NO. Z-02-19- The Matter of Linda & Ehab Habashi, Block 3404, Lot 8,

           50 Glenwild Road, Madison was reopened for discussion on a procedural question at

           the public meeting on March 15, 2004. The Zoning Board of Adjustment discussed the prior

           approval adopted by resolution on October 21, 2002. Following the discussion of the prior

           variance approval, the Zoning Board of Adjustment adopted a Supplemental Resolution

           subject to memorialization, determining that under all of the circumstances the applicants'

           project remained within the scope of the prior variance approval, thus not requiring new or

           amended variance approval proceedings. Action to be memorialized at the April 19, 2004

           meeting.

           

           NEW BUSINESS

           CASE NO. Z-03-58-Application of John Terracciano, Block 1105, Lot 8, 18 Anthony Drive,

           Madison, requesting permission to erect a 2 story addition and 2nd story addition in a R-3

           Zone District, requiring a variance for minimum front yard setback, maximum impervious

           coverage and maximum principal building coverage. The application was partially heard and

           carried to the Monday, April 19, 2004 meeting to allow the applicant to consider revisions to

           the proposal, with any revised plans submitted to the board at least ten days prior to the meeting.

           No further notice required.

 

           CASE NO. Z04-02- Application of David and Shirley Mutchler, Block 1901, Lot 9, 12

           Grove Street, Madison, requesting permission to extend the side portion of the existing deck

           by 4 ft. toward the side property line and enclose the front and side porches to create a

           sunroom in an R-3 Zone District, requiring minimum front yard setback. The application was

           approved by resolution.

 

           CASE NO. Z-04-01-Application of Richard A. and Jeanne E. Gradone, Block 0307, Lot 16

           9 Crestwood Drive, Madison requesting permission for the construction of a two-story addition

           in place of an existing front patio and existing garage in a R-3 Zone District, requiring a variance

           for minimum front yard setback and maximum principal building coverage. The application was

           partially heard and carried to the Monday, April 19, 2004 meeting to allow the applicant to

           consider revisions to the proposal, with any revised plans submitted to the board at least ten days

           prior to the meeting. No further notice required.  

   

           CASE NO. Z-04-03-Application of Paul and Susan Sirna, Block 3802, Lot 57,

           53 Albright Circle, Madison requesting permission to construct a second story addition

           which will not exceed the perimeter of the existing building in a R-2 Zone District, requiring

           a variance for minimum front yard setback and minimum side yard setback was approved

           by resolution.

 

           CASE NO. Z-04-04- Application of John Allocca t/a Kings Court Developers,

           Block 0501, Lot 12, 64 Burnet Road, Madison requesting permission to construct a

           single family dwelling on the subject property in a R-3 Zone District, requiring a

           variance for minimum rear yard setback and minimum lot depth, and such other

           variances or relief as may be deemed required by the board.  The application was

           partially heard and carried to the Monday, April 19, 2004 meeting to allow the applicant to

           consider revisions to the proposal, with any revised plans submitted to the board at least ten

           days prior to the meeting. The applicant is also required to re-notice the property owners within

           the 200' radius for the request that was added to the application for front setback variances.

 

 

 

 

 

 

                                                                    

 

          CASE NO. Z-04-05-Application of Anthony S. and Carmen Montagna, Block 0505,

          Lot 27, 2 Burnet Road, Madison requesting permission for the construction of a "deck and

          sun porch (enclosed)" addition in a R-3 Zone District, requiring a variance for minimum

          side yard setback, minimum rear yard setback, maximum principal building coverage and

          maximum impervious coverage was carried to the Monday, April 19, 2004 meeting. No

          further notice required.

 

          CASE NO. Z-04-06- Application of Bruce D. MacDougall, Block 1001, Lot 30,

          68 Central Avenue, Madison requesting permission for the conversion of a building

          containing one (1) Dwelling unit and a plumbing business to a two-family dwelling.

          The area previously occupied by the plumbing business was converted, without benefit

          of necessary approvals, to a residential unit in or about 1993. The applicant seeks relief

          from the minimum lot area and width requirements in the R-4 Zone District. The application

          was carried to the Monday, April 19, 2004 meeting. No further notice required.

 

          CASE NO. Z-04-07- Application of  Jonathan & Suzanne Shelby, Block 4102, Lot 2,

          77 Midwood Terrace requesting permission to construct a one-story addition, 2nd story

          addition, enclosure of existing sun porch, front porch and expansion of existing driveway

          in a R-1 Zone District, requiring a variance for minimum side yard setback, maximum

          impervious coverage, maximum principal building coverage and unenclosed porch

          encroachment. The application was carried to the Monday, April 19, 2004 meeting.

          No further notice required.

 

          CASE NO. Z-04-08- Application of Theresa Christie, Block 4903, Lot 10, 6 Dellwood

          Parkway South, Madison requesting permission to construct a "Pool House" which is an

          "Accessory Structure" within the "Front Yard" in a R-1 Zone District, requiring variance

          relief from Section 195-30.5B(4) of the Land Use Code of the Borough of Madison was

          carried to the Monday, April 19, 2004 meeting for notice of the public hearing to the property

          owners within 200' of the subject property.

 

          CASE NO. Z-04-09-Application of Jeffrey and Christine Schermerhorn, Block 3802,

          Lot 18, 22 Keep Street, Madison requesting permission to construct a one-story addition

          and extend the existing front porch to wrap around the left side of the house in a R-4 Zone

          District, requiring a variance for minimum front yard setback was carried to the Monday,

          April 19, 2004 meeting. No further notice required.

 

          CASE NO. Z-04-10-Application of Doug and Melissa Griffie, Block 1001, Lot 49,

          138 Central Avenue, Madison requesting permission to construct a 1 and 2 story addition

          (attaching existing detached Garage to existing Principal Structure), proposed 2nd story

          addition to Principal Structure, proposed 2nd story addition to existing Garage, proposed

          Wood Deck in an R-3 Zone District, requiring a variance for minimum side yard setback

          (Garage) (Deck) and maximum impervious coverage was carried to the Monday, April 19,

          2004 meeting. No further notice required.
