ORDINANCE 44-2005
ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 59 OF THE CODE OF THE BOROUGH OF MADISON ENTITLED "ANIMALS AND RABIES CONTROL" SECTION 4 THEREOF ENTITLED "OBTAINING LICENSE AND REGISTRATION TAG" AND SECTION 15 THEREOF ENTITLED "FEES"
WHEREAS, the Madison Board of Health has recommended amendments to the Borough Code to change the month of licensing of cats to January and increase certain fees.
NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris, and State of New Jersey, as follows:
SECTION 1: Chapter 59 of the Code of the Borough of Madison, Section 4 thereof entitled "Obtaining license and registration tag" Paragraph B thereof is hereby amended to conform the time for licensing of cats to dogs in the month of January as follows:

B. Any person who shall own, keep or harbor or suffer the keeping or harboring of any cat of licensing age within the Borough of Madison shall, in the month of January and annually thereafter, apply for and procure from the Health Department a license and official registration tag for each such cat so owned, kept or harbored and shall place upon such cat a collar, or other device with the license number securely fastened or displayed thereto. Acceptable methods of displaying license number shall include, but not be limited to, breakaway or elastic collars.

SECTION 2: Chapter 59 of the Code of the Borough of Madison, Section 15 thereof entitled "Fees" is hereby amended as follows:

Dog and Cat Licenses and Registration Tags – Annual
Neutered $ 9.00
All others $12.00
Late Charge for Dog or Cat License and Registration Tag
effective February 1st $7.00

SECTION 3: Chapter 59 of the Code of the Borough of Madison, Section 5 thereof entitled "Fees; renewal; expiration of date of license; "Seeing Eye," "service" and "hearing ear" dogs; acceptance of license from another municipality", Paragraph D thereof is amended to read as follows:

D. Any dog or cat owner or person harboring a dog or cat found to have an unlicensed dog or cat by the Borough Animal Control Officer or any other municipal official on or after February 1 shall be required to pay an additional delinquent fee, as established by § 59-15, plus the required license fee as provided in this chapter for the animal license, together with any other fines due to summons issued that may be imposed on him as provided in this chapter for failure to obtain an animal license by January 31. The aforementioned fee shall not apply to animals which have been acquired by the owner after February 1, provided said license is obtained within 10 days after acquisition and sufficient proof is presented to establish the date the dog or cat is acquired.

SECTION 4: This ordinance shall take effect immediately and upon final passage and publication as required by law.
