MINUTES

Madison Environmental Commission

January 4, 2001

[December 2000 meeting was moved to this date]

1. Open Public Meetings Act Statement E. Cicconi brought the meeting to order at 7:30 pm.

2. Roll Call (7:32 pm)

E. Cicconi, T. Haralampoudis, A. Iossa, P. Smith, C. Stevenson, B. Uhlman and R. Vaccaro were present.

3. Minutes (7:35 pm)

3.1 August 31, 2000 (E. Cicconi): The minutes were adopted as submitted.

3.2 November 30, 2000 (B. Uhlman): The minutes were adopted as submitted.

4. Old Business (7:45 pm)

4.1 MEC 2001 Schedule of Meetings. Revised dates were announced for February (March1), March (April 5) and April (May 3); otherwise the meetings will be held the last Thursday of each month (except for December 2001, which will be held in January 2002).

4.2 Natural Resources Inventory status report (update on GIS maps, scheduling, "cover contest"): MEC is contracting to have the GIS maps created by Karen Patterson, GIS Analyst for the Great Swamp Watershed Association. Janet Foster, Chair of Madison Historic Preservation Commission, has agreed to review the History section and work on the map of Madison’s Historic Sites. E. Cicconi will contact Carole Rawding, faculty advisor to Madison High School’s Environmental Club, to discuss best way to conduct proposed contest (e.g. through the MHS Environmental Club or Art Department, Board of Education, Madison Eagle).

5. Correspondence (8:00 pm)

5.2 Morris Land Conservancy notification re January 24, 2001 meeting of the Morris County Green Table: provided for the Commissioners’ information.

5.3 November 13, 2000 letter from New Jersey Department of Community Affairs, Office of State Planning re New Jersey State Development and Redevelopment Plan: Draft Final Plan and related scheduled public hearings: available for Commissioners’ review.

5.4 November 21, 2000 letter from Robert C. Shinn, Jr., Commissioner, NJ Department of Environmental Protection, enclosing copy of newly revised "NJDEP Grant & Loan Programs" catalogue: available for the Commissioners’ review.

5.5 December 6, 2000 letter from John J. Dunne, Mayor, to Barbara Doyle, Mayor, Borough of Florham Park, re Mayor’s Committee on the development of the Exxon/Mobil property: per the Mayor, only this Committee is authorized to speak on behalf of the Borough. Per E. Cicconi, the Committee has yet to meet.

5.6 December 12, 2000 letter from Randy S. Kertes, C.P.G., Omni Environmental Corporation, re application for a NJDEP Freshwater Wetlands Waiver and a NJDEP Minor Stream Encroachment permit for the Madison Commons Condominium Association: this is a routine application to clean out a storm drain.

5.7 December 19, 2000 letter from William G. Dressel, Jr., Executive Director, New Jersey State League of Municipalities re Watershed Rules Update: watershed rules proposed by NJDEP have caused much municipal and industrial comment, especially regarding home rule.

5.7A Notification of William McDonough speaking Jan. 12, 2001 in Trenton: participation welcomed.

5.7B Notification of Jan. 17, 2001 QUEST meeting on airline noise, due to increased traffic at Morristown Municipal Airport: participation welcomed. E. Cicconi has been invited and plans to attend.

(Out) 5.8 December 4, 2000 MEC letter to John Theese, Madison Health Officer, re Madison Plaza, 300 Main Street: J. Theese called DEP Dec. 7, 2000 to alert DEP of suspected hazardous substance discharge. It has been assigned a case number and J. Theese will follow up with Jerry O’Donnell at DEP and keep MEC advised.

5.8A Underground Storage Tank (UST) Discharge Notification at Fairleigh Dickinson University: DEP is requiring further investigation and cleanup. No MEC action is required; investigation is ongoing.

6. New Business (8:30 pm)

6.1 Concept Plan

Estate of Robert Burroughs, Block 1601, Lot 41, Walnut Street: will go before Zoning Board of Adjustment. At December 6, 2000 TCC meeting, attended by E. Cicconi, J. Foster stated that existing barn is outside of designated historic district. The plan must go to the TCC for completeness; it is too early for MEC to comment.

6.2 Site Plan Application

Lean Bodies, Inc., Block 2401, Lot 4, 233 Main Street: MEC has no comment on this application. E. Cicconi to send letter to Planning Board.

6.2 A Site Plan Application

ELRAC, Inc. dba Enterprise Rent-A-Car, Block 2401, Lot 4, 233 Main Street: MEC has no comment on this application. E. Cicconi to send letter to Planning Board.

6.3 Site Plan Application

Hendricks, Block 1703, Lot 3, 2 Howell Street: to be heard this month by Planning Board, which has already received MEC comments on this application [letter of July 28, 2000].

6.4 Site Plan Application

135-137 Main LLC [Madison Printing], Block 2601, Lot 15, 135 Main Street: to be heard this month by Planning Board, which has already received MEC comments on this application [letters of September 1 and October 23, 2000]. Applicant has changed the grade of the parking lot to affect water runoff and has added a roof leader drain, which require no comment by MEC at this time.

6.5 Site Plan Application, Dr. James Hollenbach, Block 2206, Lot 5, 250 Main Street (revised): parking and landscaping have changed. The impervious coverage percentage should drop slightly from existing percentage. MEC has no other comment on this application. E. Cicconi to send letter to Planning Board asking whether impervious coverage percentage should be recalculated.

6.6 Site Plan Application

Bayley Ellard High School, Block 201, Lot 1, Madison Avenue: application is scheduled for the January 30, 2001 Planning Board work session and February 6, 2001 public hearing. Applicant should confirm that size of proposed detention basin is large enough to accommodate increased stormwater runoff. There are additional concerns about the water runoff: its position on the slope, the erosion, and the outlet volume. NJ Transit has not commented on the applicant’s intention to send runoff onto the train tracks. E. Cicconi to send letter to Planning Board.

6.7 Minor Subdivision, Site Plan and Variance Application

Sunrise Development Corp., Block 201, Lot 1, Madison Avenue: Sunrise Corp. will seek a special meeting of the Zoning Board this month to secure a variance from the 50-foot buffer requirement, among other things. MEC has these observations at this time: the applications by Bayley-Ellard and Sunrise should be made and considered jointly, the runoff cannot discharge on a slope, and the 50-foot buffer should be upheld for noise and visual reasons. MEC will comment after MEC’s January 2001 meeting.
