SEALED BIDS will be received by the Borough of Madison, County of Morris, State of New Jersey, in the Council Chambers, Room 320, Top Floor, 205 Madison Avenue (off Danforth Road), Madison, New Jersey, on TUESDAY, JULY 20, 2010, 10:00 AM, prevailing time, and at that time will be publicly opened and read for the WOODLAND ROAD RECONSTRUCTION – PHASE 1. Bid prices shall remain firm for a period of sixty (60) days.

Bids shall be addressed to the Borough Clerk, Borough of Madison via:

Hand-delivery or other carrier/delivery service (NOT US Mail): 205 Madison Avenue (off Danforth Road), Room 211, Madison, New Jersey 07940.

Each Proposal must be enclosed in a SEALED ENVELOPE, properly endorsed with the name of the Bidder, with the designation "BOROUGH OF MADISON, SEALED BID, WOODLAND ROAD RECONSTRUCTION – PHASE 1, TUESDAY, JULY 20, 2010, 10:00 AM". Any envelope that is received that is not properly marked causing it to be opened prior to the bid will be invalidated. Bids may be received before the hour designated in this office, if they are mailed or hand delivered in person. The Borough of Madison will not be responsible for any bid that is sent by mail or other form of carrier which is lost or which arrives after the bid date and time, TUESDAY, JULY 20, 2010, AT 10:00 AM.

The project includes, generally, but is not limited to:
1. Police Traffic Directors – 240 Man Hrs.
2. Milling, Variable Depth - 12,650 S.Y.
3. Granite Block Curbing - 6,350 L.F.
4. Road Base Repair - 1,600 S.Y.
5. HMA Driveway Restoration, 4.5" Thick - 375 S.Y.
6. HMA. Surface Course, 9.5M64, 2" Thick - 1,455 Tons
7. 15" RCP, Class III - 772 L.F.
8. 15" RCP, Class V - 140 L.F.
9. Inlets, Type ‘B’ - 12 Units
10. Traffic Striping 4" wide Y - 12,395 L.F.

In addition to the proposal, each bidder may be required to submit a statement of his or her qualifications, experience, financial ability, equipment and a non-collusion affidavit. Failure to submit same with the proposal may result in rejection of the bid. All bids must be submitted on the Proposal Forms furnished by the Borough. Bids on any other forms will not be accepted. Bid documents and specifications are available at the Borough Clerk’s office, 205 Madison Avenue (off Danforth Road), Room 211, Madison, NJ from 8:00 AM to 4:30 PM, Monday – Friday for a non-refundable fee of $50.00. Payment must be in the form of cash, certified check or money order made payable to the Borough of Madison.

Sealed Bids must be accompanied by: (1) a duly executed Bid Proposal Guarantee in the form set forth in the Bid Package; (2) a certified check, cashier's check or bid bond, payable to the Borough of Madison, in an amount equal to 10% of the bid (based upon the highest total bid, if alternative bids are involved), but not to exceed $20,000, and (3) a duly executed Certificate of Surety and Power of Attorney on the standard New Jersey Statutory bond form, as set forth in the Bid Specifications, issued by a surety company licensed to do business in the State of New Jersey.

The Borough of Madison reserves the right to reject any or all bids and to waive any informalities therein and to accept any bid that will be in the best interest of the Borough of Madison according to N.J.S.A. 40A:11-1.

The Borough of Madison reserves the right to delete sections of work from the contract after the award of the bid has been made due to funding or other reasons. The prices bid for various items of work shall not be adjusted due to the deletion of any work due to the variation of any quantity for the various items scheduled in the Proposals. The Borough of Madison reserves the right to make separate purchase awards for various sizes and kinds of materials or equipment required, based on the low unit bids submitted on such items.

Proposals for this contract will be accepted only from bidders who have been properly qualified in accordance with the requirements of the Specifications.

Bidders are required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.

The contractor must ensure that employees and applicants for employment are not discriminated against because of their race, creed, color, sex or national origin and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Bids for proposals in excess of $l00,000 must be accompanied by a written Affirmative Action Plan.
