NOTICE TO BIDDERS
BOROUGH OF MADISON, MORRIS COUNTY, NEW JERSEY

PROSPECT STREET ELECTRICAL RECONSTRUCTION

SEALED PROPOSALS will be received by the Borough of Madison, County of Morris, State of New Jersey, in the Planning Board Room, 2nd Floor, Hartley Dodge Memorial, Kings Road, Madison, New Jersey, on FRIDAY, AUGUST 12, 2005 AT 10:00 AM, prevailing time, and at that time will be publicly opened and read for the PROSPECT STREET ELECTRICAL RECONSTRUCTION. Bid prices shall remain firm for a period of sixty (60) days.

Bids shall be addressed to the Borough Clerk, Borough of Madison in the Hartley Dodge Memorial Building on Kings Road, Madison, New Jersey 07940. Each Proposal must be enclosed in a SEALED ENVELOPE, properly endorsed with the name of the Bidder, with the designation "BOROUGH OF MADISON, SEALED BID, PROSPECT STREET ELECTRICAL RECONSTRUCTION, AUGUST 12, 2005, 10:00 AM". Any envelope that is received that is not properly marked causing it to be opened prior to the bid will be invalidated.

Bids may be received before the hour designated in this office, if they are mailed or hand delivered in person. The Borough of Madison will not be responsible for any bid that is sent by mail or other form of carrier which is lost or which arrives after the bid date and time, Friday, August 12, 2005 at 10:00 AM.

In addition to the proposal, each bidder may be required to submit a statement of his/her qualifications, financial ability, and a non-collusion affidavit. Failure to submit same with the proposal may result in rejection of the bid. All bids must be submitted on the Proposal Forms furnished by Crane Associates, P.C. Bids on any other forms will not be accepted. Bid documents, specifications and drawings, may be seen at the office of the Engineer, Crane Associates, P.C., 313 East Main Street, Somerville, New Jersey 08876-3109 and may be obtained upon payment of the sum of $50.00 for each set. Documents will be ready on Thursday, July 21, 2005. Such payment shall be non-returnable.

Sealed Proposals must be accompanied by: (1) a duly executed Bid Proposal Guarantee in the form set forth in the Bid Package; (2) a certified check, cashier's check or bid bond, payable to the Borough of Madison, in an amount equal to 10% of the bid (based upon the highest total bid, if alternative bids are involved), but not to exceed $20,000, and (3) a duly executed Certificate of Surety and Power of Attorney on the standard New Jersey Statutory bond form, as set forth in the Bid Specifications, issued by a surety company licensed to do business in the State of New Jersey.

A pre-bid meeting is scheduled for Monday, August 1, 2005 at 9:00 AM at the Borough of Madison Water and Light Plant at the intersection of John Avenue and Station Road. Attendance is strongly encouraged.

The Borough of Madison reserves the right to reject any or all bids and to waive any informalities therein and to accept any bid that will be in the best interest of the Borough of Madison according to N.J.S.A. 40A:11-1.

The Borough of Madison reserves the right to delete sections of work from the contract after the award of the bid has been made due to funding or other reasons. The prices bid for various items of work shall not be adjusted due to the deletion of any work due to the variation of any quantity for the various items scheduled in the Proposals. The Borough of Madison reserves the right to make separate purchase awards for various sizes and kinds of materials or equipment required, based on the low unit bids submitted on such items.

Proposals for this contract will be accepted only from bidders who have been properly qualified in accordance with the requirements of the Specifications.

Bidders are required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964. Bidders are required to comply with the requirements of N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.

The contractor must ensure that employees and applicants for employment are not discriminated against because of their race, creed, color, sex or national origin and to the greatest extent possible, opportunities for training and employment shall be given to lower-income residents of the project area and that, when possible, contracts shall be awarded to business concerns owned by area residents. Bids for proposals in excess of $l00,000 must be accompanied by a written Affirmative Action Plan.
